The firm is recognized as a national leader in environmental litigation. In addition to assisting private parties, the firm has been retained by New Jersey, Puerto Rico, and the U.S. Virgin Islands to assist their Attorneys General in pursuing claims against corporations that contaminated groundwater and other natural resources.
To date, we have recovered over $500 million in damages and environmental restoration projects on behalf of our public entity clients. The firm was recently retained by Maryland as co-lead counsel to evaluate and pursue claims against petroleum manufacturers who used methyl tertiary butyl ether (“MTBE”) that contaminated groundwater throughout Maryland.
States, tribes, and local governments are entitled to pursue damages for contamination of their natural resources. The Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA), the Clean Water Act (CWA), the Oil Pollution Act (OPA), and state and territorial laws provide powerful tools for states, territories, and other governmental and quasi-governmental entities to pursue claims for the harm caused by contamination that goes far beyond the cost of clean up.
Natural resources include a vast array of resources, including but not limited to streams, lakes, marine resources, wetlands, groundwater, wildlife, fish, aquatic organisms, and plant life. Drinking water, in particular, is becoming more valuable each day as more and more supplies are contaminated and sufficient supplies dwindle.
